Client Capacity – Ethical Decision Making Richard Hopkin Wednesday 29 May 2024, 12pm-1:15pm AEST | Financial advisers are confronted with clients whose capacity is declining, which raises both legal and ethical issues. As Australia’s population lives longer, more advisers will be exposed to clients with declining capacity. Advisers will also be on the front line of the “great wealth transfer” in the next few decades – planning for and managing deteriorating client capacity will be a critical element of inheritance and wealth transfer planning. Ian Raspin
Managing Director | BNR Partners & Chair | STEP
Ian is the Managing Director of BNR Partners and has specialised in the taxation of deceased estates since 2000. He commenced his career in public practice in Tasmania working predominantly with SME’s, prior to ‘migrating’ to Australia in 1998 and commencing his career with BNR Partners. BNR was named the 2019/20 global winner of ‘mid-sized accounting firm of the year’ in the prestigious Society of Trust and Estate Practitioners private client awards held in London.
Ian is recognised both nationally and internationally on Australian estate taxation matters. He is both a published author on estate taxation and a frequent presenter at both legal and accounting conferences and events, including for various Law Societies, the Society of Trusts and Estate Practitioners (STEP), CPA Australia, the Tax Institute and the College of Law. Ian also regularly provides in-house training sessions for legal firms and trustee companies, and consults with professional bodies, regulators and the private sector on estate taxation issues.
He is actively involved in the professional arena and was a 2017 finalist in the Tax Institute of Australia’s SME Tax Advisor of the year Awards and the recipient of CPA Australia’s 2016 Henry Fox Award for services to Public Practice.

Peter Bobbin

Peter Bobbin is a leading legal veteran in trusts, taxation, superannuation and estate planning. A big believer in giving back to the community, Peter is an often-requested speaker for many professional associations and is proud of his role as Charity Trustee of theFuture2 Foundation.
In 2015, Peter was honoured by the Tax Institute as the Tax Advisor of the Year (SME) and has been recognised as a preeminent Australian lawyer in estate planning.
Recently the Australian Chair of the Society of Trust and Estate Practitioners (STEP), Peter is a former university lecturer and accountant; Peter claims that he can speak both accountant’ease and legal’ease. Outside of work, Peter is married to Penny and is an enthusiastic cyclist with three great loves: good food, good wine and one other.
Kathy Havers CFP®
Kathy has been a strategic advisor for over 20 years. She merged her private practice into Viridian in September 2019. She works as a Specialist Executive Advisor and leads the Viridian Private Office team in Victoria.
Kathy’s experience and passion spans advice to high-net-worth individuals and families with specialist experience for clients with complex structures and needs. She has additional expertise in philanthropy and family succession planning. She is highly sought out as a specialist advisor to families with disabilities, having a child with complex special needs herself.
Kathy is also a Director on the Board of the Viridian Foundation, along with Kindred Spirits Foundation where she takes an active role to really make a difference to her community. She lives by the mantra of “you have not truly lived until you have done something wonderful for someone who can never possibly repay you”/ The rewards for giving and altering lives are humbling and resoundingly fulfilling for her.
Kathy is a CFP, has a Masters of Entrepreneurship and Innovation (MEI) and is a Graduate of the AICD. She has twice been awarded the Financial Planning Association’s National Award for Community Service as well as the national Award for Community Engagement for Women in Financial Services.
In 2022, Kathy was a finalist in the AFA Female Excellence in Advice Awards and was recognised as one of the top 50 most influential advisors as part of the Financial Standard Power50.
Bruce Thomas

Bruce was previously a tax manager with William Buck Chartered Accountants where he advised clients on the application of the goods and services tax, FBT and other government changes
He worked for the ATO for 17 years, including as a senior officer dealing with technical issues involving the GST. Bruce has been a trainer with CA ANZ for over 18 years.
James McPhedran
Senior Tax & Superannuation Trainer | Chartered Accountants Australia and New Zealand
James has 18 years’ experience in the industry, including roles at the Big Four accounting firms and advisory roles at mid-tier firms. He has been a trainer with CA ANZ for over 11 years and has maintained a client re-sign rate of more than 90% for 11 consecutive years.
His advanced knowledge of taxation and superannuation has allowed him to focus on SMEs and high net worth individual. James holds a bachelor’s degree in law and economics from the University of Queensland and a Masters of Taxation from the University of Sydney
Richard Hopkin

Richard Hopkin is a Senior Associate in Cowell Clarke’s Financial Services team. Richard practices predominantly in the area of financial services regulation and compliance across the financial services industry, covering Australian Financial Services (AFS) licensing and compliance, including: AFSL applications and variations, ASIC reporting and enforcement, remediation programs and IDR/AFCA matters. Richard is a key part of Cowell Clarke’s online AFSL compliance portal services.
